What is the Employee Retention Tax Credit and how might I qualify?

The ERTC is a refundable payroll tax credit based on the “Qualified Wages” paid to retained full-time employees from March 13, 2020 through December 31, 2021 by eligible employers that retained employees during the pandemic. The purpose of the ERTC was to encourage employers to keep employees on their payroll, even if they were not working during the covered, COVID-19, period.

The IRS website states, employers are eligible if they operate a trade or business, and experience EITHER:

corona

A full or partial suspension of the operation of their trade or business during this period because of governmental orders limiting commerce, travel, or group meetings due to COVID-19

market

A decline in quarterly gross receipts from 2019 as compared to the same quarters of 2020 or 2021. Where the gross receipts of a specified calendar quarter for 2020 are less than 50% of the gross receipts in the corresponding quarter in 2019 or where the gross receipts of a specified quarter in 2021 decline more than 20% as compared to the gross receipts of the corresponding quarter in 2019.

“ The ERTC is a cash credit from the IRS. It is not a loan and there are no restrictions on how a business can use it “
